Beverage industry, NYC lawyers duel over drinks

NEW YORK (AP) ? The city defended its groundbreaking size limit on sugary drinks Wednesday as an imperfect but meaningful rein on obesity, while critics said it would hurt small and minority-owned businesses while doing little to help health.

The first courtroom arguments in the closely watched case ended without an immediate ruling ? and with opponents saying they planned to ask a judge to delay enforcement during the suit, which has broached questions of racial fairness alongside arguments about government authority and burdens to business.

The NAACP's New York state branch and a network of Hispanic groups have joined a legal effort to block the first-of-its-kind restriction, igniting questions Wednesday about the groups' ties to the beverage industry.

Beverage makers, restaurateurs, minority advocates and other critics told a judge the upcoming 16-ounce limit was a finger-wagging incursion on consumer choice, rife with inconsistencies that would cost a hot dog vendor business while still allowing New Yorkers to buy belly-buster sodas at the chain convenience store next to him. Opponents' lawyers called it "ham-handed," ''grossly unfair" and just "plain silly."

"New Yorkers do not want to be told what to drink," attorney James Brandt said.

City lawyers acknowledged the rule's limitations. It doesn't apply to all high-calorie drinks or all places that sell them, largely because of the city can regulate only some establishments. But it's still a reasonable and needed move to take on the city's growing weight problem and the diseases linked to it, they said.

"While this may not be a silver bullet that will cure the obesity epidemic, it's rational ... (and) one step that can be taken," said the city Health Department's chief lawyer, Thomas Merrill.

The suit, filed by the American Beverage Association and others, seeks to block the restriction, set to take effect March 12. With no immediate ruling Wednesday, opponents said they planned to ask state Supreme Court Justice Milton Tingling to put it on hold until the case is decided. The city will oppose such a move, Merrill said after the hearing.

The latest in a line of healthy-eating initiatives during Mayor Michael Bloomberg's administration, the beverage rule bars restaurants and many other eateries from selling high-sugar drinks in cups or containers bigger than 16 ounces. Violations could bring $200 fines; the city doesn't plan to start seeking those until June.

In explaining the cola crackdown, officials cite the city's rising obesity rate ? about 24 percent of adults, up from 18 percent in 2002 ? and point to studies linking sugary drinks to weight gain. Care for obesity-related illnesses costs more than $4.7 billion a year citywide, and government programs pay about 60 percent of that, according to city Health Commissioner Dr. Thomas Farley.

Opponents portray the regulation as government nagging that scapegoats sugary drinks for a multifaceted fat problem, and they say the restriction is unfairly narrow.

Unsweetened juice and milk-based drinks are excluded; health officials say they have nutritional value. The regulation also doesn't cover alcoholic drinks or sales at supermarkets and many convenience stores ? among them 7-Eleven, home of the Big Gulp ? because they aren't subject to city health rules.

The NAACP and the Hispanic Federation, a network of 100 northeastern groups, say their concern is that minority-owned delis and corner stores will end up at a disadvantage compared with grocery chains.

But others are underscoring the groups' links to the soda companies whose fight they've joined. Among the ties:

? Coca-Cola announced last month it was giving a $100,000 grant to the national NAACP to support a healthy-lifestyles program

? PepsiCo gave the group more than $10,000 in 2010, according to the soda maker's website.

? Former Hispanic Federation President Lillian Rodriguez Lopez left for a job at Coca-Cola in in February.

? The groups were represented Wednesday by a firm that also has represented Coca-Cola. The firm, King & Spalding, is representing the advocacy groups for free, lawyer Ann M. Cook said.

Given that obesity rates are higher than average among blacks and Hispanics, the NAACP should refuse soda makers' money and "reevaluate the position the group is taking in New York City," Michael F. Jacobson, the executive director of the nutrition advocacy group Center for Science in the Public Interest, said in a statement Wednesday.

He and Stan Glantz, director of the Center for Tobacco Control Research and Education at the University of California, San Francisco, noted that tobacco companies' established relationship with African-American leadership organizations in decades past.

The strategy in the soda fight is "straight out of tobacco," Glantz said.

Hazel Dukes, the NAACP's New York president, bristled at the idea that the nearly 104-year-old group was swayed by the soda industry's support.

"No one buys the NAACP," she said in a telephone interview, noting that foundations also have contributed to the organization's obesity-fighting initiatives.

Soda makers' money "is not the issue here," she said. "The issue is fairness."

The Hispanic Federation's current president, Jose Calderon, didn't immediately return calls Tuesday and Wednesday.

Atlanta-based Coca-Cola Co. and Purchase, N.Y.-based PepsiCo Inc. didn't immediately respond to requests Wednesday for comment on their ties to the advocacy groups.

The regulation's critics also argue that the first-of-its-kind restriction should have gone before the elected City Council instead of being approved by the Bloomberg-appointed Board of Health, a view echoed Wednesday by a lawyer for nine of the 51 council members. The city says the board of doctors and other health professionals had both the authority and expertise to make the decision.

During Bloomberg's 11-year tenure, the city also has made chain restaurants post calorie counts on their menus and barred artificial trans fats in French fries and other restaurant food.

Palestinians: Israel military shot dead teen

RAMALLAH, West Bank (AP) ? Palestinians say the Israeli military has shot dead a 17-year-old Palestinian boy near the West Bank separation barrier.

A classmate said a group of students went to the barrier that Israel has built along and inside the West Bank to throw stones at soldiers. Muataz Awad says soldiers opened fire, killing Samir Awad from the village of Boudrous.

Doctors at Ramallah hospital say he was shot three times. They spoke anonymously according to regulations. The military had no immediate comment.

Elsewhere in the West Bank, about 50 armed Palestinians shut the main road into Balata refugee camp to protest Palestinian security forces' attempts to disarm them.

The gunmen have links to Palestinian President Mahmoud Abbas' Fatah movement. Their recent protests draw attention to growing discontent with his rule.

Bottom-up approach provides first characterization of pyroelectric nanomaterials

Jan. 8, 2013 ? By taking a "bottom-up" approach, researchers at the University of Illinois at Urbana-Champaign have observed for the first time that "size does matter," in regards "pyroelectricity" -- the current/voltage developed in response to temperature fluctuations that enables technologies such as infrared sensors, night-vision, and energy conversion units, to name a few.

Using a high-power, pulsed laser to deposit materials from a plasma plume (shown here), researchers synthesized materials to study their unique pyroelectric properties at the nanoscale.

"Controlling and manipulating heat for applications such as waste heat energy harvesting, integrated cooling technologies, electron emission, and related functions is an exciting field of study today," explained Lane Martin, an assistant professor of materials science and engineering (MatSE) at Illinois. "Traditionally, these systems have relied on bulk materials, but future nanoscale devices will increasingly require ferroelectric thin films.

"Measuring the pyroelectric response of thin films is difficult and has restricted the understanding of the physics of pyroelectricity, prompting some to label it as 'one of the least-known properties of solid materials'," Martin added. "This work provides the most complete and detailed modeling and experimental study of this widely unknown region of materials and has direct implications for next generation devices.

Researchers found that reducing the dimensions of ferroelectrics increases their susceptibility to size- and strain-induced effects. The group's paper, "Effect of 90-degree domain walls and thermal expansion mismatch on the pyroelectric properties of epitaxial PbZr0.2Ti0.8O3 thin films," appears in the journal Physical Review Letters.

"What we did in this work was to develop a new approach to utilize and understand a class of materials important for all of these applications," Martin said. "By moving to a 'bottom-up' approach that produces nanoscale versions of these materials as thin films, we have observed, for the first time, that certain features, namely domain walls, can be incredibly important and even dominate the temperature-dependent response and performance of these materials."

According to J. Karthik, a MatSE graduate researcher and first author on the group's paper, thin-film epitaxy has been developed to provide a set of parameters (e.g., film composition, epitaxial strain, electrical boundary conditions, and thickness) that allow for precise control of ferroelectrics and has been instrumental in understanding the physics of dielectric and piezoelectric effects.

"We investigated the contribution of 90? domain walls and thermal expansion mismatch to pyroelectricity in ferroelectric PbZr0.2Ti0.8O3 thin films, a widely used material whose bulk ferroelectric and piezoelectric properties are well understood," Karthik explained. As part of this work, Martin's Prometheus research group developed and applied the first phenomenological models to include extrinsic and secondary contributions to pyroelectricity in polydomain films and predict significant extrinsic contributions (arising from the temperature-dependent motion of domain walls) and large secondary contributions (arising from thermal expansion mismatch between the film and the substrate).

"We have also developed and applied a new phase-sensitive pyroelectric current measurement process to measure thin films for the first time and reveal a dramatic increase in the pyroelectric coefficient with increasing fraction of in-plane oriented domains and thermal expansion mismatch consistent with these models," Karthik said.

"By establishing an understanding of the science of these effects, with models to predict their performance, and demonstrated techniques to fabricate and utilize these properties in nanoscale versions of these materials, their properties can be effectively integrated into existing electronics," Martin said.

Sony's 65-and 55-inch Ultra HD TVs, eyes-on

The message of tonight's Sony CES press event? Bigger's not always, better, we guess. The huge reveal on the side of the stage at tonight's event were two new Ultra HD TVs-- smaller siblings of the positively massive 84-inch beast we've already seen. But what these guys lack in sheer size, they make up for a bit with bezel. There's a lot that on either side of the display. That's where the magnetic fluid speakers live, right in the middle of the glossy black expanse.

The overall effect is a TV that looks much wider than it is tall. The TV also looks a fair bit thicker than a lot of the HDTVs current on the market. As for the display itself -- that's great, as to be expected. As lifelike as Kaz suggested on-stage, though some of the colors do look a touch oversaturated as you get up close to the thing. The TV sits atop a shiny silver ring that juts out a bit from the front. The new models measure 65- and 55-inches. They're due to arrive this spring.

Anglo close to hiring rival's CEO for top job: sources

LONDON (Reuters) - Mining giant Anglo American is close to hiring Mark Cutifani, the boss of rival AngloGold Ashanti , as its new chief executive officer, two sources familiar with the situation said.

Cutifani would replace Cynthia Carroll, who said in October she would resign as CEO under pressure from investors over the miner's lagging share price and dependence on strike-hit South Africa.

Cutifani is the frontrunner and an announcement could come before mid-January, one of the sources said, but no final decision has been made.

Australian Cutifani has run AngloGold, created from Anglo American's gold assets, since 2007.

Should he be hired, he would become only the second non-South African and only the second outsider to head the group after New Jersey-born Carroll, in what analysts and investors say is one of the toughest jobs in the resources sector.

Other candidates in the running include Rene Medori, Anglo's finance director, and Peter Whitcutt, the firm's director of strategy and business.

Along with Cutifani, ex-BHP Billiton chief financial officer Alex Vanselow and chief executive of Xstrata Mike Davis are among the external candidates who have been tipped for the job.

Anglo American declined to comment. AngloGold could not immediately be reached for comment.

49ers Preparing To Face Packers (And Not Vikings) In NFL Playoffs' 2nd Round

SANTA CLARA, Calif. (AP) ? The San Francisco 49ers are preparing for next week's division-round playoff game as if they already know their opponent.

With a first-round bye a trio of San Francisco scout teamers wore the jerseys numbers of key Green Bay Packers during Friday's practice.

They simulated top Green Bay wide receivers Randall Cobb and Jordy Nelson along with tight end Jermichael Finley as third-string 49ers quarterback Scott Tolzien tossed passes.

"There's definitely some game planning going on," said tight Garrett Celek, who swapped his usual No. 81 jersey for a red No. 88, which is Finley's number.

"Still, we're not sure who we're going to play. But since we have this week, we're taking advantage of it and getting certain things ready for whatever happens next week."

The Packers, seeded third in the NFC, host No. 6 Minnesota on Saturday night. If Green Bay beats the Vikings, the Packers will play at San Francisco on Jan. 12.

Otherwise the 49ers (11-4-1) will host the winner of Sunday's game between fourth-seeded Washington and No. 5 Seattle.

Among the other 49ers in different uniform numbers: Chad Hall wore No. 18 (Cobb) and Ricardo Lockette dressed in No. 87 (Nelson).

"It's definitely helpful. We've faced those guys before and we have a potential of seeing those guys again," Pro Bowl safety Dashon Goldson said.

Typically, Ed Donatell, who coaches the secondary, and other defensive assistants bring practice squad wide receivers, tight ends and running backs into meetings to teach players tendencies of San Francisco's opponent that week. Offensive assistants will do the same for defensive players tagged for the "look team."

Players will take that knowledge onto the practice field against the first-team offense and defense to prepare the starters for the game. If nothing else, it gets players used to seeing the routes and numbers of their upcoming opponent.

The only difference this week is that the 49ers don't actually have an opponent.

"I think it's really important. We have all this time off, so you might as well take advantage of it," said Celek, the brother of Philadelphia Eagles tight end Brent Celek.

"I think to just sit on our butts and do nothing wouldn't be very smart. We've got to get ahead of the curve and I think this is a good way to do it."

While the 49ers won't practice again until Monday, players will be tuned into this weekend's games.

Players said they'll be watching as casual observers, leaving the scouting for the film coaches to break down when they return to 49ers headquarters.

They also said it doesn't make a difference what team they face, though Washington would be the only possible opponent San Francisco hasn't seen yet.

The 49ers won 30-22 at Green Bay in Week 1. They split both games against the Seahawks, winning 13-6 in Week 7 at San Francisco and falling 42-13 at Seattle in Week 16 ? the most lopsided loss of coach Jim Harbaugh's two-year tenure.

"It's all about consistency," left tackle Joe Staley said. "You've got to do it again. What you did last time doesn't mean anything going into next game. We just have to continue to improve. We just got to be consistent and do it again. That's the challenge each and every week is just to build on any successes you had last week and change anything you didn't do well the week before. That's our focus."

Four dead after standoff in Aurora, Colo.

AURORA, Colo. (AP) ? A gunman barricaded inside his Colorado home fired shots at police from a second-story window before he was killed as SWAT officers stormed the home Saturday. Once inside, they found the bodies of three other adults, authorities said.

The suspect, whose name was withheld by police, held officers at bay for nearly six hours after neighbors reported gunfire at 3 a.m. inside the modest townhome in the Denver suburb of Aurora, said police Sgt. Cassidee Carlson. It wasn't known if officers shot the suspect or if he shot himself.

Investigators said two men and a woman appeared to have been killed before officers arrived.

The suspect shot at police who approached the front of the home with an armored vehicle and who fired tear gas around 8:15 a.m. He was killed when he fired at officers from the second-story window about 45 minutes later, Carlson said.

"After we arrived on scene, there were no more shots fired up until he fired at us," Carlson said. "During this time he was all over the house. He moved furniture. He was throwing things. He was agitated. He was irrational."

A large front window was missing in the two-story townhome, the window's mini-blinds in disarray. Bullet holes marked two upstairs windows, and neighbors milled about outside.

A fifth person escaped unharmed and called police to report that she saw three people inside the home who "appeared lifeless," said Carlson, who declined to elaborate about the woman's escape.

A motive for the killings was unknown, and police had yet to say what weapon or weapons were used. Investigators wearing gloves and carrying evidence bags were going over the crime scene.

Police declined to release the victims' names.

"We have an idea of who they are, but we obviously want to confirm their identities with the coroner," said Carlson, who declined to release the relationship between the victims and the shooter.

Officers evacuated neighbors' homes during the standoff and used a bullhorn to communicate with the gunman, urging him to surrender.

Next-door neighbor Melissa Wright, a nurse who treated victims of the July movie theater shootings in Aurora, said she was in her second-floor bedroom when she saw the gunman start shooting from his own bedroom window. She said she didn't know what he was shooting at, and that she quickly dropped to the floor.

"I hit the ground pretty fast," Wright said.

Wright said she slid on her belly to the first floor of her home and told police what she saw upstairs. Officers quickly entered her home.

Wright said she knew the gunman as Sonny Archuleta ? a name used by police officers trying to negotiate with the man with the bullhorn. Wright said the townhome may have been inhabited by the gunman, the gunman's wife, her father and another man.

The shootings occurred about four miles southeast of the Aurora Mall, where 12 people were killed and dozens were wounded by a gunman at a midnight showing of "The Dark Knight Rises" on July 20. The man charged in that shooting, James Holmes, goes to court Monday for a preliminary hearing in which prosecutors will present their case against him.

The July shootings prompted Gov. John Hickenlooper ? just before the Newtown, Conn., massacre ? to say it is time to debate gun control. It's expected to be a heated topic at the Colorado Legislature this year.

Aurora, just east of Denver, is one of Colorado's largest and most diverse cities with more than 335,000 residents. It is home to Buckley Air Force Base as well as the sprawling University of Colorado Health Sciences Center campus, where James Holmes studied neuroscience before the movie theater shootings.

Confess? Armstrong may not have much to gain

(AP) ? Lance Armstrong may be considering a change in course, dropping his years of denials and admitting that he used performance-enhancing drugs ? though whether such a move would help him is uncertain.

The New York Times, citing anonymous sources, reported late Friday that Armstrong has told associates he is thinking about the move.

However, Armstrong attorney Tim Herman says that the cyclist hasn't reached out to USADA chief executive Travis Tygart and David Howman, director general of the World Anti-Doping Agency.

A USADA spokeswoman declined comment on Saturday, while Howman was quoted by the Sunday Star-Times in New Zealand, where he is vacationing, saying Armstrong has not approached his group.

USADA stripped Armstrong of his seven Tour de France titles last year and issued a report portraying the cyclist as the leader of a sophisticated doping operation on his winning teams.

Public confessions and apologies have been the route of redemption for several athletes who have gotten in trouble.

For example, Tiger Woods said he was sorry for cheating on his wife in televised speech, and baseball slugger Mark McGwire eventually admitted to steroid use. Yet Armstrong faces serious legal entanglements those megastars didn't, and a confession to doping could end up complicating matters for Armstrong ? not making them easier.

The U.S. Department of Justice is considering whether to join a federal whistle-blower lawsuit filed by former Armstrong teammate Floyd Landis alleging fraud against the U.S. Postal Service during the years the agency sponsored Armstrong's teams.

A Dallas-based promotions company has also said it wants to recover several million dollars paid to Armstrong in bonuses for winning the Tour de France. And the British newspaper The Sunday Times is suing to recover about $500,000 paid to Armstrong to settle a libel lawsuit.

Armstrong has testified under oath that he never used performance-enhancing drugs, which could theoretically lead to charges if he confessed. Former U.S. track star Marion Jones spent several months in federal prison for lying to investigators about her drug use.

And after so many years of vehement denials and sworn statements that he never doped, at this point, what would Armstrong gain from a confession? There would be no guarantee that his personal sponsors would return or that the public would accept it.

Is the public even interested in an Amrstrong confession?

Gene Grabowski, executive vice president of Levick, a Washington, D.C.-based crisis and issues management firm, said "it may be too little, too late because he's been denying it for so long."

A confession would only work to salvage Armstrong's reputation if he accepted full responsibility and blamed no one else, Grabowski said. And it would have to include some public act of atonement.

"If he does all three, he has a shot," Grabowski said. "You have to show people you are willing to pay a price."

The New York Times reported the 41-year-old Armstrong may be considering a confession in an attempt to reduce his lifetime ban from cycling and Olympic sport so he can return to competing in triathlons and elite running events.

Armstrong lost most of his personal sponsorship worth tens of millions of dollars after USADA issued its report and he left the board of the Livestrong cancer-fighting charity he founded in 1997. He is still worth about a reported $100 million.

Livestrong might be one reason to issue an apology. The charity supports cancer patients and still faces an image problem because of its association with its famous founder.

And if Armstrong did confess, the corporate sponsors who abandoned him might support him again, Grabowski said.

"They'll do what the public does," Grabowski said.

Betsy Andreu, the wife of former Armstrong teammate Frankie Andreu, was one of the first to publicly accuse Armstrong of using performance-enhancing drugs.

She dismissed a potential confession from Armstrong as self-serving and too late.

"Sorry, your chance is over. You're banned for life. It's not with an asterisk, that because you are Lance Armstrong you get to come back," Andreu said. "He does not belong in sport."

No matter how tight the contracts may be, the market situation changes quickly, and, as with any form of investment, there is a chance that you may lose the money ? so don't put in more than you can afford.

Think Like a Bank

When using peer to peer lending sites, you can either allow the respective company to administer your portfolio entirely, or you can interview the bad credit loan applicants yourself, and decide on a case by case basis. If you're just starting out and you're not entirely sure how things work, it is perhaps better to let the company make the decisions for you, since they already have the experience and some criteria in place to evaluate borrowers.

The system allows you to get considerable returns on investment, on average of 9-10%, so the profits are greater than what you can expect from mostly anything else available on the market today, but the risks are also considerable. Start with a conservative portfolio, and expand later, if you feel this is the right direction for you.

You will probably want to ask the applicants the same questions that a bank would normally ask: their credit score, their current income and income to debt ratio, and so on. Remember that most people use peer to peer lending because they cannot qualify for a loan from a traditional lender, so don't expect to see spotless credit history.

Don't Be Afraid to Say No

You take considerable risks with your money, so you naturally want to make a profit, not to provide charity or a public service. You will probably hear a lot of heartbreaking stories, and you will meet a lot of people in desperate need for financing, but you have to learn how to limit the risks. In other words, you have to learn to simply say no, when you feel the investment would be a wrong choice for you.

If things go wrong, and you have to recover your money via a court of law, you will be asked to prove that the borrower had a sound financial situation at the time when the agreement was signed, and you had reasonable ground to believe that he or she would be able to repay the loan on time. If you cannot prove that, the chances of ever getting your money back are slim, so weigh your options carefully.

The biggest issue with peer to peer lending is balancing privacy options with the right to access information about the borrower. For example, in some cases it may be important to find out why the applicant wants a loan ? it's not the same if they need it to pay for a vacation at a luxury resort or for a home remodeling job. On the other hand, the peer to peer lending companies have consultants and procedures in place, so you can always ask for help if you're not sure what to do. ?

2012 was worst year for whooping cough since 1955

The nation just suffered its worst year for whooping cough in nearly six decades, according to preliminary government figures.

Whooping cough ebbs and flows in multi-year cycles, and experts say 2012 appears to have reached a peak with 41,880 cases. Another factor: A vaccine used since the 90s doesn't last as long as the old one.

The vaccine problem may continue to cause higher than normal case counts in the future, said Dr. Tom Clark of the Centers for Disease Control and Prevention.

"I think the numbers are going to trend up," he said. The agency provided the latest figures on Friday.

Last year, cases were up in 48 states and outbreaks were particularly bad in Colorado, Minnesota, Washington state, Wisconsin and Vermont.

The good news: Despite the high number of illnesses, deaths didn't increase. Eighteen people died, including 15 infants younger than 1.

Officials aren't sure why there weren't more deaths, but think that the attention paid to bad outbreaks across the nation resulted in infected children getting diagnosed faster and treated with antibiotics.

Also, a push last year to vaccinate pregnant women ? a measure designed to pass immunity to infants ? may have had some small measure of success, Clark said.

The final tally will be higher but unlikely to surpass the nearly 63,000 illnesses in 1955, he said.

Whooping cough is a highly contagious disease that can strike people of any age but is most dangerous to children. Its name comes from the sound children make as they gasp for breath.

It used to be a common threat, with hundreds of thousands of cases annually. Cases gradually dropped after a vaccine was introduced in the 1940s.

For about 25 years, fewer than 5,000 cases were reported annually in the U.S. But case counts started to climb again in the 1990s although not every year. Numbers jumped to more than 27,000 in 2010, the year California saw an especially bad epidemic.

Experts looking for an explanation have increasingly looked at a new vaccine introduced in the 1990s, and concluded its protection is not as long-lasting as was previously thought.

Children are routinely vaccinated with five doses beginning at 2 months, and a booster shot is recommended at around 11 or 12. Health officials are considering recommending another booster shot, strengthening the vaccine or devising a brand new one.

(AP) ? Facing an insurgency by a new rebel coalition, the president of Central African Republic consolidated military power under his control Thursday after dismissing his own son as acting defense minister along with his army chief of staff.

President Francois Bozize said in a decree read on state radio late Wednesday that he was taking over the position held by his son, Jean Francis Bozize as neighboring countries sent troops to help.

Hundreds of soldiers from Chad, Republic of Congo, Gabon and Cameroon have been in arriving this week in this desperately poor, landlocked country where rebels have seized 10 towns in a month's time.

Rebel spokesman Col. Djouma Narkoyo reiterated Thursday that they were holding their position at the transportation hub of Sibut pending negotiations in Gabon. They have apparently made no further advance toward the capital since taking the town on Dec. 29.

"Our position today is that we respect the decision of the Economic Community of Central African States," he said by satellite phone. "That's why we are staying in Sibut and are not advancing."

In New York, France's U.N. Ambassador Gerard Araud said there will be a meeting in Libreville, Gabon on Jan. 8 to promote a political solution to the crisis, mediated by President Denis Sassou Nguesso of the Republic of Congo.

"The goal is to have a political agreement in Libreville, a national unity government ... and eventually a peaceful settlement," he told reporters after a closed-door briefing to the U.N. Security Council Thursday on the latest developments in the Central African Republic by U.N. political chief Jeffrey Feltman.

Araud said the African Union and regional groups are in the lead and have been very active, and the Security Council is supporting them and will likely issue a press statement Friday. He said France planned to circulate the text to the 14 other council members on Thursday evening.

"They have stopped the rebels, and they have ideas about a national unity government," Araud said of the AU and regional groups. "So everything will be discussed in the meeting in Libreville on the 8th, and after the meeting in Libreville we'll see whether the U.N. has to do something."

Residents in the capital of Bangui said Bozize's decision to fire his own son was not surprising given the recent military losses. But some noted Bozize may be making his moves too late.

"It's coming too late because the security of our country is already in the hands of rebels," said Jean Nestor Kongbu as he watched fishermen cast their nets in the Obangui River that separates Central African Republic from Congo. ... They say they won't advance, but the government could provoke the rebels or the rebels could provoke the government. They need to negotiate for the Central African people."

The sudden military reorganization also suggests that Bozize's regime may be weakening, said Thierry Vircoulon, the project director for Central Africa at the International Crisis Group.

"If he is dismissing his own son, it means he is getting more and more isolated," Vircoulon said.

Jennifer Cooke, director of the Africa program at the Washington-based Center for Strategic and International Studies, said people see Bozize "as a losing ticket right now."

"People are losing confidence in him and he has every reason to be a bit paranoid right now watching the disintegration of the country," she said.

The United Nations called for talks between the government and rebels and the Security Council scheduled closed consultations on the Central African Republic on Thursday afternoon.

The rebels have indicated they will participate in upcoming talks in Gabon but are also insisting that Bozize go. The president says he will not leave before finishing his term in 2016.

Bozize himself took power in 2003 following a rebellion with the help of Chadian forces. He later went on to win elections in 2005 and 2011, though the opposition and international observers have called the votes deeply flawed.

The rebels behind the latest challenge to Bozize's rule are made up of four separate groups all known by their French acronyms ? UFDR, CPJP, FDPC and CPSK. They are collectively known as Seleka, which means alliance in the local Sango language, but have previously fought one another. In September 2011, fighting between the CPJP and the UFDR left at least 50 people dead in the town of Bria and more than 700 homes destroyed.

Just 70 miles (112 kilometers) to the south of Sibut, government and regional forces are fortifying the town of Damara, where truckloads of Chadian troops patrol with rocket-propelled grenades and other weapons.

Gen. Jean Felix Akaga, who heads the regional force known as FOMAC, says a push on Damara, 45 miles (75 kilometers) north of the capital, would be "a declaration of war" on the 10 Central African states.

"For us, Damara is the red line that the rebels cannot cross," Akaga said Wednesday. "If they attack Damara, we will attack."
